Erika Kirk is asking the court to reject Charlie Kirk’s accused killer’s request for a 2029 trial date.

“Every additional day of delay carries the weight of all that Charlie’s murder has taken from his family, especially his two young children who were just 3 and 1 years old when their father was murdered and would be 7 and 5 years old by the time a verdict is handed down under the Defense’s proposed schedule,” Erika’s attorney Jeffrey Neiman argued in court documents obtained by Us on Thursday, October 22. “What’s worse, the defendant’s core argument for delay is that there is such an overwhelming amount of evidence — a perverse position that has no legal basis.”

Erika, 37, and her lawyer believe the defense’s tentative third-quarter 2029 trial target is “a timeline which is grossly out of line with comparable cases.”

They are asking for a trial date no later than the government’s proposed readiness date of October 4, 2027.

“Each hearing induces anxiety, pain and mourning,” Erika’s attorney argued in court documents. “The Kirk family deserves to have this matter resolved expeditiously.”

Erika’s team is also pushing for a 2027 start date, claiming “the cost to the public is also significant.”

“Not only are conspiracy theorists, trolls, click chasers and rage-baiters willing to exploit the uncertainty resulting from delay to spin tales that undermine confidence in the State of Utah and its justice system, the taxpayers are also paying an unprecedented financial cost that will only grow as the trial date is delayed,” Erika’s attorney argued.

A hearing is scheduled for Friday, October 23, regarding the timetable for the trial of defendant Tyler Robinson.

The 23-year-old is accused of fatally shooting Charlie during a 2025 university event for the nonprofit Turning Point USA. Robinson has pleaded not guilty to seven counts, including aggravated murder and felony discharge of a firearm causing serious bodily injury.

Robinson’s defense team has requested that the trial begin in the third quarter of 2029, with quarterly motion hearings until then “specifically devoted to assessment of the continuing viability of beginning trial during the third quarter of 2029,” they state in a scheduling memo.

They claim to need time to prepare for “critical” jury selection and coordinate with expert witnesses.

Prosecutors intend to seek the death penalty if Robinson is convicted of the murder charge.

Erika previously revealed that she forgave the man allegedly responsible for her husband’s death.

“I forgive him because it is what Christ did,” Erika said during Charlie’s September 2025 memorial service. “The answer to hate is not hate.”
